The General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679) is a new regulation which replaces the Data Protection Regulation (Directive 95/46/EC)

The Regulation aims to harmonise data protection legislation across EU member states, enhancing privacy rights for individuals and providing a strict framework within which commercial organisations can legally operate.

This Policy explains when, why and how we collect personal information about people who visit our website, apply for our advertised vacancies, use our social media sites or make general contact. It also details how we use it, the conditions under which we may disclose it to others and how we keep it secure.

Who are we?

We are Red Chilli Recruitment Limited, a leading Engineering and Technical specialist recruiter. We are a recruitment agency and recruitment business as defined in the Employment Agencies and Employment Businesses Regulations 2003.  We are dedicated to helping candidates find their next role and clients find their next key hire. 


How do we collect information from you?

We obtain information about you when you use our website, for example, when you contact us about roles or make enquiries about our services or if you send your cv via the website, by emailing it direct or through a social media site such as Facebook, LinkedIn, Twitter

On a daily basis, we also source potential candidates from a number of job board websites. These websites are designed to assist us in the recruitment process and by uploading your contact details and CV on to these websites, you are agreeing to their privacy policy with regards to sharing that information with third parties such as ourselves.



What type of information is collected from you?

The information you give us or we collect about you may include your name, address, demographic information such as post code, private and corporate e-mail address and phone number, financial information, compliance documentation and references verifying your qualifications and experience and your right to work in the United Kingdom, curriculum vitae and photograph, employment details, employment preferences, links to your professional profiles available in the public domain e.g. LinkedIn, Twitter, business Facebook or corporate website


How is your information used?

We may use your information to:

• Ascertain suitability for roles we are recruiting for

• To carry out our obligations arising from any roles we are recruiting for such as forwarding your CV or personal details where necessary to our clients. Your personal details will only be forwarded to a client when a job offer is made and with your consent.

• Contact you via Telephone, Email, Text for updates on your current employment and to ensure our records are accurate

• Seek your views or comments on the services we provide

• Notify you of changes to our services

• Send you communications which you have requested and that may be of interest such as latest vacancies or news


We review our retention periods for personal information on a regular basis. We are legally required to hold some types of information to fulfil our statutory obligations. We will hold your personal information on our systems for as long as is necessary for the relevant activity, or for a period of 24 months.

Our legal basis for the processing of personal data is our legitimate business interests, although we will also rely on contract, legal obligation and consent for specific uses of data.

Our legitimate interests in collecting and retaining your personal data are that as a recruitment business and recruitment agency we introduce candidates to clients for permanent employment, temporary worker placements or independent professional contracts. The exchange of personal data of our candidates and our client contacts is a fundamental, essential part of this process.

In order to support our candidates’ career aspirations and our clients’ resourcing needs we require a database of candidate and client personal data containing historical information as well as current resourcing requirements.

To maintain, expand and develop our business we need to record the personal data of prospective candidates and client contacts.

To deliver our ancillary services we need to contact candidates on a regular basis, through various routes such as email, phone, job alerts and other relevant notifications



Should we want or need to rely on consent to lawfully process your data we will request your consent orally, by email or by an online process for the specific activity we require consent for and record your response on our system. Where consent is the lawful basis for our processing you have the right to withdraw your consent to this particular processing at any time.


Who has access to your information?

• We will not sell or rent your information to third parties.

• We will not share your information with third parties for marketing purposes.

• We may transfer your personal information to a third party (our clients or payroll company) as part of a successful offer of employment to enable them to arrange the necessary contracts to be drawn up. However, we will take steps with the aim of ensuring that your privacy rights continue to be protected.

Your choices

You have a choice about whether you wish to receive information from us or not. If you do not want to receive direct communications from us about the latest roles, then you can select your choices by ticking the relevant boxes when you apply through our website initially, or by simply replying to any email or text message you receive from us.

 The GDPR provides you with the following rights:

  • Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
  • Under the new GDPR legislation, you now have the right to 'Request to be Forgotten'. What this means is that we will remove all personal data we hold about you from our database barring your name. By holding your name on file we can ensure we don't contact you in the future
  • Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your personal information for direct marketing purposes.
  • Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.

  • Request the transfer of your personal information to another party in certain formats, if practicable.
